        Senate Reverses Self, Approves Real-Time Transmission Of Election Results, But…

        IN A SIGNIFICANT legislative reversal, the Nigerian Senate on Tuesday approved the electronic transmission of election results directly from polling units, following intense public debate over the integrity of the nation’s electoral process.

        The decision amends a contentious clause in the proposed Electoral Act and mandates the Independent National Electoral Commission (INEC) to transmit results electronically where technically feasible.

        The Senate’s action specifically alters Clause 60(3) of the Electoral Act (Amendment) Bill. Just last Wednesday, the red chamber had voted to retain the existing law’s provision for the “transfer” of results; a term widely interpreted as allowing for manual movement of results before any electronic step, a method critics labelled as vulnerable to interference.

        Facing mounting public pressure, the Senate Chief Whip, Senator Mohammed Monguno (APC, Borno), moved a motion to rescind last week’s decision, citing the “controversy” his earlier motion for retention had generated as his reason for the about-face.

        “The controversy that it has generated has led me to rescind the decision,” Monguno stated on the Senate floor on Tuesday.

        The motion was seconded by the Minority Leader, Senator Abba Moro (PDP, Benue), leading to a recommittal of the clause and its subsequent amendment.

        The New Provision: Transmission with a Paper Backup

        The newly passed clause establishes a clear hierarchy for result transmission. It mandates that the Presiding Officer at each polling unit must first complete and sign the physical Result Form EC8A in the presence of party agents. Following this, the results are to be transmitted electronically directly to INEC’s Result Viewing Portal (IReV).

        Crucially, the amendment includes a safeguard for technical failures. It stipulates that “if the electronic transmission of the result fails as a result of communication failure, the result contained in Form EC8A… shall, in such a case, be the primary source for collation and declaration of results.”

        This provision, while ensuring a fallback, has also become the new focal point of the ongoing controversy.

        Background: The Prevailing Controversy

        The debate over real-time electronic transmission is not new but has been a central fault line in Nigeria’s electoral reform efforts for years.

        Proponents, including civil society organisations, pro-democracy activists, and many opposition figures, argue that instantaneous electronic transmission from the polling unit is the most critical safeguard against ballot-box snatching, alteration of results during transit, and manipulation at collation centres. They view it as non-negotiable for restoring public trust in electoral outcomes.

        Opponents, often citing Nigeria’s challenging network coverage in rural areas, have historically argued that a mandatory e-transmission requirement could disenfranchise voters in regions with poor infrastructure.

        They advocate for flexibility, a position critics allege is a pretext for maintaining the opaque manual collation process where malpractices have historically occurred.

        The Senate’s initial decision last week to reject e-transmission was met with widespread condemnation, fuelling perceptions of a retreat from electoral transparency.

        Today’s reversal, while hailed as a victory for transparency advocates, leaves the door open for debate on the “technical failure” clause.

        Critics warn that this exception could be exploited to manually submit results in politically sensitive areas, potentially undermining the very transparency the electronic system is designed to ensure.

        Way Forward

        Following the passage, Senate President Godswill Akpabio announced a conference committee, chaired by Senator Simon Lalong (APC, Plateau South), to harmonise the Senate’s version with that of the House of Representatives before the bill is sent to President Bola Tinubu for assent.

        The final shape of this clause will be closely watched, as it is poised to define the technological framework for Nigeria’s next general elections.
