THE ATTORNEY-GENERAL of the Federation (AGF) and Minister of Justice, Lateef Fagbemi, SAN, has stated that the decision to discontinue the criminal charge against Dr. Nneka Onyeali-Ikpe, Managing Director of Fidelity Bank Plc, reflects a steadfast dedication to upholding justice and fairness.
This was disclosed in a statement issued on Monday in Abuja by Mr. Kamarudeen Ogundele, Special Assistant on Communication and Publicity to the AGF.
The AGF clarified that the decision followed a thorough review of the case, which revealed no substantive link between Dr. Onyeali-Ikpe and the charges.
The review established that she was neither the account officer nor the Managing Director of Fidelity Bank at the time the account implicated in the alleged fraudulent scheme was opened.
“As the Chief Law Officer of the Federation, the AGF is constitutionally empowered to enter a nolle prosequi, discontinuing a prosecution where necessary to prevent a miscarriage of justice,” the statement read.
“The decision was reached after a meticulous examination of the case, which found no evidence connecting Dr. Onyeali-Ikpe to the charge, as she held neither of the aforementioned positions when the account in question was opened.”
“The Attorney-General’s decision is guided by the principles of justice, fairness, and the rule of law. We are confident that this action serves the best interest of justice and the public,” the statement further noted.
The AGF emphasized that the discontinuation of the charge does not absolve Fidelity Bank of the allegations, which remain pending before the court. Rather, the decision reflects the Attorney-General’s duty to ensure that justice is administered equitably.
“The public is urged to allow the legal process to proceed without undue speculation or premature conclusions. The AGF remains committed to ensuring that justice is served at all times and that any individual found culpable will face the full consequences of the law as a deterrent to others,” the statement concluded.
