Rivers’ State Of Emergency: A Necessary Measure Or Executive Overreach? By Victor Itodo Abuh

THE SUSPENSION of Governor Siminalayi Fubara and the declaration of a state of emergency in Rivers State have set off one of the most contentious episodes in Nigeria’s recent political history.

On the one hand, the federal government cites escalating security challenges — most notably, the sabotage of vital oil infrastructure — as justification for this drastic intervention. On the other hand, critics warn that such measures undermine Nigeria’s constitutional order and risk setting a dangerous precedent for executive overreach.

Proponents of the suspension argue that the deteriorating security situation in Rivers State left no alternative. As reported by different media outlets, the President justified his decision by stating: “No responsible president could remain passive under such grave circumstances,” referring to the repeated pipeline vandalism and the resultant economic and security threats.

In this view, the extraordinary action was a necessary bulwark against a spiraling crisis that imperiled both local communities and national interest.

This controversy is compounded by the opaque manner in which political rivalries appear to have influenced the decision. The notable absence of any mention of former Governor Nyesom Wike’s significant role in the crisis further fuels suspicions of bias. Such selective accountability not only calls into question the fairness of the intervention but also risks deepening divisions among political actors and the public.

Yet, the unilateral suspension of a democratically elected governor and the sidelining of state lawmakers raise profound concerns about the erosion of democratic norms.

Critics argue that the use of emergency powers, especially in a politically charged environment, skirts the constitutional safeguards that are supposed to restrain the executive. As one state official starkly put it: “It is shocking that Mr. President sacked the governor and left his minister,” a sentiment that encapsulates the alarm among many in Rivers over what they see as a politically selective intervention.

Ultimately, while the security challenges in Rivers State are real and demand urgent action, the suspension of state leadership under the cover of a state of emergency must be approached with utmost caution.

The Nigerian Constitution provides mechanisms for addressing governance failures and bypassing these procedures — however well-intentioned — can have lasting repercussions on the nation’s democratic fabric.

If this intervention is to be viewed as a legitimate exercise of executive power, it must be accompanied by transparency, a clear timeline for the restoration of constitutional order and robust checks by the judiciary and legislature. Otherwise, we risk normalising extraordinary measures that can be wielded for political expediency rather than the common good.

The current crisis in Rivers State should serve as a clarion call: security concerns, no matter how pressing, must never become a pretext for the erosion of the democratic ethos that now define our society.
