NCSU: Same Judge Reverses Self on Interim Order Stopping Delegates Conference

THE Honourable Justice S. Dalyop Pam, who on May 19, 2022, gave an interim order stopping the delegates conference of the Nigerian Civil Service Union (NCSU) had on Monday, May 23, 2022, reversed himself by discharging the order.

Justice Pam gave the fresh Order after an oral application by Mr T. Anaba Esq. who stood for the applicant.

The discharge Order reads: “Upon the oral application made this 23rd day of May, 2022 praying that the Exparte Order made on the 19th day of May 2022 be discharged.

“And after hearing T. Anaba Esq., Learned Counsel for the Applicant urging the Court that the earlier order made on the 19th May, 2022 be discharged;

“And this Honourable Court having ruled;

“It is hereby ordered as follows:

“The earlier order granted by this Honourable Court on 19th day of May, 2022 is hereby discharged.”

Comrade Menele Ziadam Nzidee, a member of the NCSU, had on May 18, 2022 through his lawyers, filed a Motion Exparte before the court against NCSU and three others praying for the stoppage of the union’s delegates conference then billed to hold between May 20th and 22nd, 2022 in Abuja.

National Record had reported earlier that Justice Pam granted all the prayers by Comrade Nzidee and fixed June 3, 2022 for mention.

“After reading the affidavit in support of the Motion paper sworn to by Comrade Menele Ziadam Nzidee, of No. 5 Chief Amadi Street, Eagle Island, Port Harcourt, Rivers State and filed at this Court’s Registry… It is hereby ordered as follows:

“That an interim order of this Honourable Court is hereby granted restraining the 1st Defendant/Respondent whether acting by itself, through the Public Trustee appointed for it by the President of the National Industrial Court or through its Agents, Officers, Employees, Servants, Assigns, Privies, Representatives or otherwise howsoever called or described from holding its National Delegates Conference (Physical or Virtual) conducting the election for National Executive Council (NEC) or any other election slated to hold between 20th and 22nd May, 2022 or any other decided date pending the hearing and determination of the Motion on Notice.

“That an interim order of this Honourable Court is hereby made restraining the President of the National Industrial Court from Directing, prescribing and instructing the Public Trustee appointed for the 1st Defendant on how to undertake his mandate of holding National Delegate Conference (Physical or Virtual) of the 1st Defendant or any other election slated to hold between 20th and 22nd May, 2022 or on any other decided date pending the determination of the Motion on Notice.

“That order of interim injunction is hereby granted directing all the parties to maintain status quo pending the hearing and determination of the Motion on Notice,” Justice Pam had ordered.

The conference is now rescheduled to hold from Friday, 27th May to Saturday, 28th May 2022 when a new leadership of the union will emerge.

Delegates are expected to arrive Abuja on Thursday, 2022.
